Terms and Conditions

1. Definitions

• "Rivelko", "the Service": the SaaS platform available at https://app.rivelko.com, operated by Raymardev.
• "User", "Owner": the natural or legal person who registers with Rivelko to create and manage forms.
• "Visitor": the person who interacts with a form created by a User through the embedded widget.
• "Form": a conversational or classic form created with Rivelko.

2. Acceptance of the terms

By registering for or using Rivelko, the User agrees to be bound by these Terms and Conditions, the Privacy Policy and the Cookie Policy. If you do not agree with any of these terms, you must not use the Service.

3. Description of the service

Rivelko offers:

• Creation of intelligent forms using artificial intelligence from a business description or a URL.
• Two form modalities: conversational (AI chat) and classic (traditional fields).
• A widget embeddable on any website with a single line of code.
• A management panel with statistics, responses, webhook configuration and visual customization.
• Email and webhook notifications when forms are completed.

4. Registration and account

• The User must provide truthful information and keep it up to date.
• Each person or entity may hold a single account.
• The User is responsible for keeping their access credentials secure and for all activity that takes place under their account.
• Rivelko reserves the right to suspend or cancel accounts that violate these terms.

5. Plans and pricing

Rivelko offers a free plan and two paid plans. Amounts are expressed in euros and are processed through Stripe in accordance with clause 6.

Annual billing. Paid plans can be billed monthly or annually. Annual billing applies an approximate 17% discount: Pro 290 €/year and Business 790 €/year.

Add-on modules. On any paid plan, optional modules can be enabled, each with an additional monthly fee prorated on the invoice: CRM (19 €/mo), Tickets (12 €/mo), Analytics (12 €/mo) and Webhooks (15 €/mo). These features are not included in the plan's base fee and can be enabled or disabled at any time from the settings panel.

Overage. Each plan includes a number of monthly conversations. On the free plan, once that number is reached new conversations stop until the following period. On paid plans, each conversation beyond the included allowance is billed at 0.05 € per conversation (usage-based billing). The User may set a maximum overage spending limit from the panel; once that limit is reached, additional conversations stop until the next billing period.

Prices may be modified with 30 days' notice. Price changes will not affect the current billing period.

6. Payments and billing

• Payments are processed through Stripe. Rivelko does not store credit card data.
• Subscriptions are billed in advance — monthly or annually, depending on the chosen cycle — and renew automatically. Add-on modules are prorated, and overage is billed in arrears.
• The User may cancel their subscription at any time from the settings panel. Cancellation takes effect at the end of the billed period.
• No refunds are made for partial periods, except where required by applicable law.

7. Acceptable use

The User agrees not to use Rivelko to:

• Collect personal data without a legal basis or without informing the visitor.
• Send spam, phishing or any fraudulent or misleading content.
• Distribute malware or malicious code through the forms.
• Collect data from minors under 16 without the consent of their legal guardians.
• Perform scraping, reverse engineering or attempt to access other users' data.
• Intentionally overload the Service's infrastructure.
• Use the Service for illegal activities under Spanish law or the law of the User's country.

8. Ownership of the data

• The User retains full ownership of all data collected through their forms.
• Rivelko does not use the data of the User or their visitors for its own purposes, marketing or AI model training.
• Visitors' messages are sent to OpenAI solely to generate the AI assistant's responses in conversational forms. This data is not retained by OpenAI under its API data policy.

9. Service availability

Rivelko strives to keep the Service available on an uninterrupted basis. However, 100% uptime is not guaranteed and the Service may experience interruptions due to maintenance, updates or force majeure.

Rivelko will not be liable for damages arising from the temporary unavailability of the Service.

10. Limitation of liability

• Rivelko is provided "as is", without express or implied warranties of merchantability or fitness for a particular purpose.
• The Owner's total liability to the User, for any cause, is limited to the total amount paid by the User over the last 12 months.
• The Owner will not be liable for indirect, incidental, special or consequential damages, including loss of profits or data.

11. Cancellation and data deletion

• The User may cancel their account at any time by contacting support@rivelko.com.
• Upon account cancellation, all forms, responses and associated data will be deleted within a maximum of 30 days.
• Only the data necessary to comply with legal obligations (tax records) will be retained.

12. Changes to the terms

Rivelko reserves the right to modify these terms. Significant changes will be communicated by email at least 15 days in advance. Continued use of the Service after notification constitutes acceptance of the new terms.

13. Governing law and jurisdiction

These terms are governed by Spanish law. For the resolution of disputes, the parties submit to the courts and tribunals of Las Palmas de Gran Canaria, without prejudice to the rights that may correspond to the consumer under applicable regulations.
